Music Lesson Agreement: Luton Music Academy LLC

1. EFFECTIVE DATE
Except as otherwise specified herein, all terms and conditions of this Agreement shall take effect on July 7, 2025 (“Effective Date”). Notwithstanding the foregoing, any change to the hourly rate specified herein shall take effect on August 1, 2025 for clients who, as of the Effective Date, are paying a lower hourly rate.

2. LESSON FEES AND PAYMENTS
Lesson Rate: $75 per hour. Lessons that are scheduled to be shorter or longer than one hour will be calculated based on this rate.
Home Visit Fee (St. Augustine): $24 flat fee (covers multiple back-to-back lessons at one location). Availability is not guaranteed, and longer drives may incur higher fees. This fee is treated like lesson time for cancellation purposes.
Accepted Payments: Autopay required (credit or debit card). Cash, checks and cash apps not accepted.
Payment System: Autopay details are accessible through the MyMusicStaff student portal.
Payment Schedule: Payment is due by the 21st for the upcoming calendar month of service. You will be invoiced and charged on the due date.

3. UNRECEIVED PAYMENTS
If we are unable to process an automatic payment, you are responsible to submit payment on the student portal (credit or debit card only), and to rectify the autopay issue (e.g. update your card on file on the student portal) as soon as possible.
Accounts unpaid by the 26th may result in termination of lessons.

4. TRIAL LESSON
We may offer one or more free 30-minute trial lesson(s). Check the website and promo material for conditions and availability.
Rescheduling or cancelling a trial lesson results in forfeiting the free trial.

5. INTRODUCTORY PERIOD
Your first four lessons (including the free trial) are considered a risk-free introductory period.
You may switch teachers during this time if scheduling allows, resetting your 4-lesson intro period.
To withdraw during this period, provide at least 48 hours' notice before your 5th lesson for a full refund of unused regular lessons, excluding makeup lessons and lessons within 48 hours of cancellation. Makeup lessons and credits are forfeited without refund.

6. STUDENT RESPONSIBILITY
Students or their parent/guardian(s) are responsible for maintaining communication with Luton Music Academy, and are required to check emails and texts from the Academy, which may include scheduling and billing information, as well as important studio updates and announcements.
Students should bring all required materials, including notebooks and method books.
Regular practice is expected.
Students must refrain from disruptive behavior and be respectful and focused during lessons.
Teachers and/or Luton Music Academy, LLC representatives will inform students/guardians if basic expectations are not being met in regards to good behavior, attendance, practice, and bringing materials to class.
Not following these basic guidelines may be grounds for termination of lessons.

7. LESSON SCHEDULE
Students are assigned a recurring weekly lesson time. Timely, regular attendance is expected.
If you are late for a lesson, your lesson will still end at the scheduled time.
You will be assigned a specific weekly time and teacher. We will do our best to keep this consistent, but at times, a change in teacher and/or lesson time may be necessary. If this occurs, you may 1) accept the new schedule, 2) request alternative options, or 3) withdraw from Luton Music Academy within 14 days of the change, with no advance notice required. If you withdraw, you will be charged for past lessons and lessons scheduled within 48 hours of withdrawing. You will be refunded for any lessons scheduled more than 48 hours in the future, excluding makeup lessons and credits, which will be forfeited.
You may be offered a substitute teacher when your teacher is absent. You may accept the substitute lesson, abiding by all lesson policies, or cancel the lesson at no charge.
Schedule changes, cancellations and makeups must be made via the Student Portal or by contacting the scheduling coordinator directly.
If you request a new weekly time and none is available, you may remain in your current slot or withdraw (see Withdrawal). You may be placed on a waiting list.
Frequent absences or tardiness may lead to termination of lessons.

8. CANCELLATIONS
Lessons cancelled with at least 48 hours' notice will receive a makeup credit (see Makeup Lessons, below).
Rescheduled lessons and planned absences are considered cancellations unless you plan to be away for 3 or more weeks and reserve your spot with a deposit (see Holding Your Spot).
Please cancel your lesson if the student or attending family members are sick and contagious. For cancellations due to illness, makeup credits or specially scheduled makeup lessons may be offered at the discretion of the teacher and studio.

9. MAKEUP LESSONS
Makeup credits may be applied as payment for specially scheduled makeup lessons only. They may not be applied towards regular weekly lessons or redeemed for cash.
Makeup credits expire 8 weeks after the original cancelled lesson date.
You are responsible for booking your makeup lesson through the Student Portal or by contacting the office.
A no-show or cancellation of a makeup lesson with less than 48 hours’ notice forfeits the makeup credit.
Availability of makeup lessons is not guaranteed. When a suitable makeup time cannot be found, the credit is forfeited.

10. WITHDRAWAL
After the introductory period (first 4 lessons), 30 days' notice is required to withdraw from lessons.
Unused makeup credits are forfeited upon withdrawal.
Missing lessons without notice does not count as a withdrawal and does not remove your financial responsibility. After four no-call/no-shows, lessons will be terminated, the timeslot released, and all missed lessons charged.

11. HOLDING YOUR SPOT
We will only hold your spot for one vacation per season, as follows:
During St. Johns County Public School’s Academic Year: one vacation of 3-4 weeks
During St. Johns County Public School’s Summer Break: one vacation of 3-8 weeks
Requirements:
Submit your absence dates in writing, including the last lesson date before your break and the exact date of your return. E.g. “My last lesson will be June 1st before my break. I will be returning for lessons on August 5th.”
No Schedule Changes: You cannot extend your absence or change your return date once confirmed. If you leave early or delay your return, you may be charged for cancelling any scheduled classes.
If you decide to extend your break beyond the agreed period (see Absence Length Guidelines), you may 1) treat any resulting missed classes as cancellations, with charges and makeup credits issued according to our cancellation policies, or 2) you may re-register for regular lessons, agreeing upon a new start date, and forfeiting your deposit.
Makeup Credits:
Credits may expire during your break, as they are subject to the 8-week expiration policy.
Note: We cannot guarantee the same lesson time or instructor upon your return if your absence exceeds the allowed period.

12. STUDIO CLOSURES AND CANCELLATIONS
If the studio cancels a lesson for any reason (e.g. teacher absences, weather events), you will not be charged, and any payment for a lesson that is cancelled by Luton Music Academy will be credited to the next billing cycle.
You may choose to book a makeup lesson at the standard rate.

13. TERMINATION BY LUTON MUSIC ACADEMY
Lessons may be cancelled or terminated by Luton Music Academy at any time and for any reason, including but not limited to teacher illness or repeated student/guardian failure to comply with this agreement.
If terminated, all future lessons are cancelled. You will be charged for any past debits on file. You will be issued a refund for lessons more than 48 hours in the future, not including makeup lessons or makeup credits.

14. USE OF TOUCH
Playing instruments, including using one's voice, is a highly complex, physical activity. Even the smallest habitual problem with tension, posture or misalignment can over time lead to debilitating performance-related injuries such as tendonitis, carpal tunnel syndrome and focal dystonia, as well as contributing to shoulder and spinal problems.
Touch is used to identify tension, correct alignment, and help students develop their own kinesthetic awareness. This work is crucial for beginners and essential where players have developed physical habits which require somatic (movement) retraining. It is also important for refining technique in more advanced students.
The purpose of touch is always explained when physical contact is necessary, so that the student is able to engage positively and effectively in learning.
Instructors check before using touch in their instruction, obtaining on-the-spot permission in addition to the general permission granted by acceptance of this Policy.
Physical contact is never used unnecessarily, inappropriately, or without consent.

15. RECORDING OF LESSONS TO ENSURE SAFETY
Luton Music Academy prioritizes the safety and security of its instructors, students, and their family members. For this reason, Luton Music Academy reserves the right to conduct audio and video recordings within every lesson room. These recordings are strictly for the purpose of enhancing safety, monitoring instructional quality, and ensuring the security of all individuals within the Academy.
The recorded material will be handled with the utmost confidentiality and will only be accessed by authorized personnel of Luton Music Academy as necessary. Such access will be for internal use only, except as needed for law enforcement or court purposes.
By agreeing to this policy, students, guardians, and instructors acknowledge and consent to the recording of lessons. This consent is part of our broader efforts to maintain a safe, secure, and supportive learning environment for everyone involved with Luton Music Academy.

16. PHOTO, VIDEO & AUDIO RELEASE

17. LIABILITY
I release, indemnify and hold harmless Luton Music Academy, LLC, its managing member(s), owner(s), directors, managers, employees, contractors and agents (“Luton Music Academy, LLC Parties”) from and against any and all liability, claims, demands and causes of action whatsoever, arising out of or related to any loss, damage, or injury, that may be sustained by the student, any family member and/or the undersigned, while in or upon the premises or any premises under the control and supervision of any of the Luton Music Academy, LLC Parties.

18. REVISION OF AGREEMENT
Luton Music Academy reserves the right to amend, modify, add, or remove any terms of this agreement at any point. Such amendments will be effective only upon providing reasonable notice to the student or, if the student is a minor, their parent or guardian. Acceptance of the amended terms must also be in writing, signifying the student and/or parent/guardian's agreement to the changes. Failure to provide written acceptance of the amended terms within the notice period provided may result in termination of this agreement and all lessons at the discretion of Luton Music Academy.
PHOTO & VIDEO RELEASE
Authorization is required to participate in recitals
Option 1: I grant permission for Luton Music Academy, its agents, and its employees, the unrestricted right to record, edit, use, reproduce, publish and distribute photographs, video recordings and images, and audio recordings, in whatever kind of media (electronic or otherwise) taken of me, or members of my family, for the purpose of publication, promotion, illustration, advertising, or trade, in any manner or in any medium. I understand that there shall be no payment for this release. I understand that no royalty, fee or other compensation shall become payable by reason of such use.
I hereby release Luton Music Academy and its legal representatives for all claims and liability relating to said images, audio and/or video.
I understand that I may revoke this authorization at any time by notifying Luton Music Academy in writing. However, I understand that any revocation will not affect Luton Music Academy’s right to use any photos, images or audio/video recordings, or any actions, that were taken before the receipt of any written revocation. I also understand that any revocation may affect my or my family’s ability to attend certain events, performances and other activities.
Option 2: I do not grant permission for Luton Music Academy, its agents or its employees the right to take or record photos, videos, audio or other media of myself or members of my family, other than for the purposes of safety, security and the monitoring of instructional quality. I understand that by not giving permission, my family members and I may be barred from participating in certain events, performances and other activities.
